Some Demanding Access to Opposite Sex Bathrooms, Locker Rooms… What is the Godly Response?

On May 13, 2016 the U.S. Department of Education and the U. S Department of Justice issued a “Dear Colleague Letter” claiming that Title IX requires schools to treat students consistent with their gender identity, including allowing students access to locker rooms, restrooms, and similar facilities of the opposite biological sex. This would allow a male student who feels that he is female to gain access to girls’ locker rooms and restrooms, and vice versa. It asserts that they also have all the rights and opportunities granted students with the biological sex they claim based on personal assertion.

It is the opinion of many attorneys that Title IX does not direct such, and that the Department of Education does not have the right to withhold funds from schools that do not follow Washington’s guidance on this issue. They further believe that districts have an obligation to defend student’s constitutional right to privacy.

Most past court cases have supported the concept that separate bathrooms do not violate Title IX. The Department of Education has attempted to redefine the meaning of sex in the 40-year-old legislation and threatened the penalty of losing federal funds; this has launched 25 states into federal court to halt this wrong.

I recently met with an ADF attorney who assured me they would defend at no cost, any district who was willing to protect students’ privacy based on biological sex.

As many cases dealing with these issues are headed to our U. S. Supreme Court, let’s stay in prayer for rulings that protect our students. In the meantime, we suggest districts adopt policies that are just and they are willing to defend to their parents and in the courts.

Availing ourselves of the institutions of law and government originally ordained by God is at least one part of our Godly response and responsibility to protect and provide safety for others.
